Judge makes document ruling

A Saginaw County circuit judge has ordered attorneys in a dioxin-related lawsuit to certify that they have handed over all relevant documents "in their possession" to Dow Chemical Co.

Attorneys representing 173 residents along the Tittabawassee River who are suing Dow over dioxin contamination squabbled with the company this week over the language of the order. It originally asked attorneys to confirm that they had surrendered all documents.

"We cannot possibly make a statement under oath that we have produced all documents when there may be documents we have no knowledge of," said Bruce Trogan, an attorney for the residents.

Chief Circuit Judge Leopold P. Borrello won't require it, an order released Wednesday reads.

The attorneys must vouch only for documents they possess, the judge said. t
